Can the insurance company deny the request of a procedure from a doctor of there choice in a workers compensation case. Doctor wants to do a lumber epidural steroid injection. The doctor is not a work comp doctor but is our second opinion doctor, but of their choice.

Our response

An injured worker will have a very strong argument in his favor if the doctor selected by the comp carrier is recommending a procedure and they are still denying it. That is the kind of issue which should be pushed to trial very quickly. Sometimes insurance companies take very week positions. It is up to your lawyer to push them to trial and force the issue. They should not get away with denying you care when their own doctor says you need it. Best of luck.
