How is my disability compensation rate determined in a Longshore case?

Your disability compensation rate is calculated at 2/3 of your average weekly wage (AWW). You’re AWW is an average weeks wage based upon your earnings for the 52 weeks prior to your date of accident. If you did not work substantially the whole of those 52 weeks, we can use a similar employee or other method to fairly assess your earning capacity prior to the 52 weeks prior to your date of accident.
