If you are a Longshoreman, shipbuilder or harbor worker who is injured on the job, you have one year from the date of your accident, or one year from the last time you were voluntarily paid compensation on account of your accident, to file a claim with the United States Department of Labor. If you have an occupational disease as a result of your work, the LHWCA allows you two years from the date of your accident, or two years from the date you knew or should have known that the employment was causing or contributing to your occupational disease, in order to file your claim with the United States Department of Labor.
